TERMS AND CONDITIONS OF USE

1. OWNERSHIP OF THE WEBSITE AND ACCEPTANCE OF TERMS
These Terms and Conditions of Use (“Terms”) apply to the website located at https://www.texasskylinemedia.com/, including all related webpages, contact forms, booking systems, client portals, galleries, and online features operated through the website, collectively referred to as the “Site.”
The Site is owned and operated by Lone Star Realty Solutions, LLC, doing business as Texas Skyline Media (“Texas Skyline Media,” “TSM,” “we,” “us,” or “our”).
By accessing, browsing, submitting information through, requesting services through, booking services through, or otherwise using the Site, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the Site.
These Terms govern your use of the Site. Photography, videography, aerial photography, drone videography, virtual tours, floor plans, marketing content, editing, and other professional services may be governed by a separate proposal, invoice, order confirmation, media license, or Client Service Agreement.
If there is a conflict between these Terms and a separate written agreement governing purchased services, the separate written agreement will control regarding those services.
2. CHANGES TO THESE TERMS
Texas Skyline Media may change, modify, add, or remove portions of these Terms at any time.
Updated Terms will become effective when posted on the Site unless a different effective date is stated.
It is your responsibility to review these Terms periodically. Your continued use of the Site after updated Terms are posted means that you accept the changes.
3. PERMITTED USE OF THE SITE
Subject to your compliance with these Terms, Texas Skyline Media grants you a limited, personal, revocable, non-exclusive, and non-transferable right to access and use the Site for legitimate informational and business purposes.
You may use the Site to:
- Review information about our services.
- View our portfolio and examples of our work.
- Request a quote or consultation.
- Submit property or project information.
- Request or schedule media services.
- Review available packages.
- Communicate with Texas Skyline Media.
No ownership rights, licenses, or other permissions are granted except as specifically stated in these Terms or another written agreement.
4. INFORMATIONAL NATURE OF THE SITE
The information displayed on the Site is provided for general informational, promotional, and business purposes.
Descriptions of services, packages, pricing, equipment, turnaround times, service areas, availability, deliverables, and results may be changed or updated without notice.
Information displayed on the Site does not constitute a binding offer unless it is specifically included in a written proposal, confirmed order, invoice, or Client Service Agreement issued by Texas Skyline Media.
Submitting a contact form, property address, quote request, or booking request does not guarantee that Texas Skyline Media has accepted the assignment.
5. WEBSITE CONTENT AND INTELLECTUAL PROPERTY
The Site may contain:
- Text and written materials.
- Logos, trademarks, and branding.
- Photographs and aerial photographs.
- Videos and drone footage.
- Virtual-tour demonstrations.
- Floor plans and property layouts.
- Illustrations and graphics.
- Website designs and layouts.
- Marketing materials.
- Package descriptions.
- Software, code, and interactive features.
- Other media and creative materials.
These materials are collectively referred to as “Site Content.”
Unless otherwise identified, Site Content is owned by or licensed to Texas Skyline Media and is protected by applicable copyright, trademark, intellectual-property, and unfair-competition laws.
Without prior written authorization, you may not:
1. Copy, download, reproduce, republish, distribute, sell, license, or commercially exploit Site Content.
2. Remove, hide, alter, or interfere with any copyright notice, watermark, logo, trademark, metadata, attribution, or ownership notice.
3. Use Site Content to create a competing website, media business, package, campaign, portfolio, training program, dataset, or derivative work.
4. Use our photographs, videos, branding, or portfolio examples to represent that you created the work.
5. Use the Texas Skyline Media name, logo, trademarks, or branding in a way that suggests sponsorship, partnership, affiliation, or endorsement without written permission.
6. Use Site Content to train, develop, test, or improve an artificial-intelligence system, machine-learning model, image generator, dataset, or automated content system without written authorization.
Limited sharing through social-media tools provided on the Site is permitted as long as the content is not altered, ownership information remains visible, and the sharing does not falsely suggest an affiliation or endorsement.
6. OWNERSHIP AND LICENSING OF CLIENT MEDIA
Photographs, videos, aerial imagery, virtual tours, floor plans, graphics, and other media created by Texas Skyline Media are protected creative works.
Unless Texas Skyline Media transfers copyright ownership through a signed written agreement, Texas Skyline Media retains copyright ownership in all media it creates.
Payment for services generally purchases a limited license to use the delivered media. Payment does not automatically transfer copyright ownership.
The permitted use of delivered media will be governed by the applicable proposal, invoice, order confirmation, media license, or Client Service Agreement.
Unless different terms are provided in writing, media created for a real estate listing is licensed to the ordering client for marketing the specific property for which the media was created.
Clients may not sell, sublicense, assign, distribute, or transfer delivered media to another agent, brokerage, homeowner, builder, contractor, landlord, property manager, publication, vendor, or third party unless Texas Skyline Media provides written permission or the applicable license specifically allows the transfer.
Media may not be materially altered, edited, filtered, composited, converted into artificial-intelligence-generated content, stripped of metadata, or presented in a misleading manner without authorization.
Reasonable cropping or resizing required by a listing platform or social-media platform is permitted.
Additional licensing fees may apply when media will be used for:
- Commercial advertising.
- Builder or developer marketing.
- Vacation-rental marketing.
- Property-management advertising.
- Hotel or hospitality marketing.
- Editorial publication.
- Paid advertising campaigns.
- Long-term branding campaigns.
- Resale or licensing to another business.
- Use by another listing agent or brokerage.
- Any purpose beyond the original property listing.
7. PORTFOLIO AND PROMOTIONAL USE
Unless Texas Skyline Media agrees otherwise in writing, we may display media created during a project in our:
- Professional portfolio.
- Website.
- Social-media accounts.
- Presentations.
- Advertisements.
- Proposals.
- Demonstrations.
- Competitions.
- Educational materials.
- Other business-marketing channels.
We will honor written confidentiality agreements and reasonable written requests involving sensitive, private, confidential, occupied, or security-sensitive properties.
A client who requires complete confidentiality or prohibits portfolio use must communicate that requirement in writing before the scheduled media session.
8. CLIENT-PROVIDED CONTENT
Clients and Site users may provide Texas Skyline Media with:
- Property descriptions.
- Logos.
- Photographs.
- Videos.
- Music.
- Floor plans.
- Graphics.
- Documents.
- Listing information.
- Access instructions.
- Other materials.
You retain ownership of materials that you lawfully own.
By providing materials to Texas Skyline Media, you grant us a limited, non-exclusive license to access, reproduce, edit, process, display, transmit, and use those materials as reasonably necessary to:
- Respond to your request.
- Prepare a proposal.
- Perform the requested services.
- Produce and deliver media.
- Host an online gallery or virtual tour.
- Provide customer support.
- Complete related administrative functions.
By submitting materials, you represent that:
1. You own the materials or have permission to provide and use them.
2. Our authorized use of the materials will not violate another person’s copyright, trademark, privacy, publicity, contractual, or intellectual-property rights.
3. The information you provide is accurate and not intentionally deceptive.
4. The materials do not contain malicious code, illegal content, or content that violates these Terms.
Texas Skyline Media is not responsible for determining whether every item provided by a client has been properly licensed.
9. PROPERTY INFORMATION AND ACCESS AUTHORITY
When submitting a property or project for service, you represent that you are authorized to request the services and provide Texas Skyline Media with the required property access.
You are responsible for obtaining any necessary permission from:
- The property owner.
- Tenants or occupants.
- Property managers.
- Homeowners’ associations.
- Builders or contractors.
- Listing agents or brokerages.
- Event organizers.
- Other persons controlling the property.
You must disclose known hazards, restricted areas, animals, occupancy conditions, security systems, construction activity, access limitations, or other circumstances that could affect the safety or completion of the assignment.
Submission of a property address does not constitute permission to enter private property.
10. DRONE AND AERIAL SERVICES
Drone and aerial services are subject to:
- Weather conditions.
- Airspace restrictions.
- Temporary flight restrictions.
- Property conditions.
- Safety considerations.
- Equipment limitations.
- Visibility.
- Government requirements.
- Operational feasibility.
Texas Skyline Media may delay, modify, relocate, cancel, or decline an aerial operation when we determine that the operation cannot be performed safely, legally, or responsibly.
The appearance of aerial services on the Site does not guarantee that aerial services can be performed at every property, location, altitude, or requested time.
11. ESTIMATES, BOOKINGS, AND PAYMENTS
Website prices and package descriptions are subject to change.
Displayed prices may not include:
- Travel charges.
- Property-size adjustments.
- Special-access fees.
- Expedited delivery.
- Advanced editing.
- Licensing upgrades.
- Rescheduling fees.
- Taxes.
- Additional services.
A service request becomes confirmed only after Texas Skyline Media accepts the request and provides a scheduled appointment, proposal, order confirmation, invoice, or other written confirmation.
Payment terms, deposits, cancellations, rescheduling, weather delays, refunds, delivery schedules, revision policies, and additional charges will be governed by the agreement or confirmation applicable to the project.
Texas Skyline Media reserves the right to correct pricing, package, scheduling, typographical, or technical errors before accepting an order.
12. PROHIBITED CONDUCT
You may not use the Site to:
1. Violate any applicable law, regulation, court order, or legal obligation.
2. Infringe the intellectual-property, privacy, publicity, contractual, or other rights of another person.
3. Submit fraudulent, false, misleading, defamatory, threatening, obscene, or unlawful material.
4. Impersonate another individual, business, property owner, agent, brokerage, or organization.
5. Request services for a property or project without proper authority.
6. Gain or attempt to gain unauthorized access to the Site, servers, user accounts, galleries, files, forms, or connected systems.
7. Probe, scan, or test the vulnerability of the Site.
8. Bypass authentication, security features, access controls, or usage restrictions.
9. Introduce viruses, malware, ransomware, malicious code, corrupted files, or other harmful technology.
10. Interfere with the operation, security, performance, or availability of the Site.
11. Use robots, spiders, scrapers, crawlers, automated extraction systems, or similar technology to collect or reproduce Site Content without written permission.
12. Collect personal information about Site users without authorization.
13. Place an unreasonable or disproportionately large load on the Site or connected systems.
14. Send unsolicited commercial messages, spam, fraudulent requests, or deceptive communications.
15. Manipulate message headers, identifiers, booking information, or payment information.
16. Use Site Content or delivered media to misrepresent a property, conceal a known condition, or deceive potential buyers, tenants, investors, or members of the public.
Texas Skyline Media may investigate suspected violations and cooperate with lawful requests from courts, government agencies, regulatory authorities, or law enforcement.
13. ACCOUNTS, PASSWORDS, AND SECURITY
Certain Site features may require an account, password, private link, access code, or client-gallery credential.
You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account or access link.
You agree to notify Texas Skyline Media promptly if you become aware of:
- Unauthorized account access.
- A compromised password.
- Unauthorized gallery access.
- Suspicious account activity.
- Another security incident involving your account.
You may not use another person’s account, credentials, gallery link, or private materials without authorization.
Texas Skyline Media is not responsible for losses resulting from your failure to protect your credentials or access links.
14. PRIVACY
Our collection, storage, processing, and use of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using the Site, you acknowledge that electronic communications and internet transmissions cannot be guaranteed to be completely private or secure.
Do not submit highly sensitive information through an unsecured contact form or general email unless specifically requested through an appropriate secure process.
15. INTELLECTUAL-PROPERTY COMPLAINTS
Texas Skyline Media respects the intellectual-property rights of others.
A person who believes that material appearing on the Site infringes a copyright, trademark, or other intellectual-property right may send a written notice to:

16. THIRD-PARTY WEBSITES AND SERVICES
The Site may contain links to third-party websites and services, including:
- Listing platforms.
- Scheduling systems.
- Payment processors.
- Social-media platforms.
- Virtual-tour hosts.
- Mapping services.
- Cloud-storage providers.
- Other independent service providers.
Third-party services are not controlled by Texas Skyline Media.
Texas Skyline Media does not guarantee and is not responsible for their:
- Content.
- Security.
- Availability.
- Accuracy.
- Privacy practices.
- Terms and policies.
- Products or services.
- Acts or omissions.
Your use of a third-party service is governed by that third party’s own terms and policies.
A link does not necessarily represent Texas Skyline Media’s endorsement of the linked company, content, product, or service.
17. WEBSITE AVAILABILITY AND DISCLAIMERS
Texas Skyline Media works to maintain an accurate, functional, and professional Site.
However, we do not guarantee that the Site will always be available, uninterrupted, secure, complete, current, accurate, or error-free.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND SITE CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
TEXAS SKYLINE MEDIA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AVAILABILITY, SECURITY, AND NON-INFRINGEMENT.
Texas Skyline Media does not warrant that:
- The Site will meet every user’s requirements.
- Every defect will be corrected.
- The Site will be free from viruses or harmful components.
- Information will always be complete or current.
- Use of the Site will produce a specific business, listing, sales, rental, marketing, or financial result.
Professional media can improve the presentation and marketing of a property, but Texas Skyline Media does not guarantee that a property will:
- Sell.
- Lease.
- Receive a specific number of offers.
- Receive a specific number of views.
- Achieve a particular price.
- Sell within a particular amount of time.
- Produce any specific financial or marketing result.
18. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Texas Skyline Media, Lone Star Realty Solutions, LLC, and their owners, members, managers, employees, contractors, representatives, licensors, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising from or connected with:
- Your access to the Site.
- Your use of the Site.
- Your inability to access or use the Site.
- Reliance on Site Content.
- Third-party websites or services.
- Unauthorized access to information.
- Interrupted communications.
- Lost profits.
- Lost revenue.
- Lost business.
- Lost opportunities.
- Lost data.
- Lost goodwill.
- Reputational damage.
- Malware or harmful technology transmitted through a third party.
- Any other matter involving the Site.
Where liability cannot legally be excluded, Texas Skyline Media’s total liability arising from your use of the Site will not exceed the greater of:
1. The amount you paid specifically for access to the Site during the six months preceding the event giving rise to the claim; or
2. One hundred dollars.
This limitation applies only to claims arising from use of the Site.
Liability connected with purchased professional services may be addressed separately in the applicable proposal, invoice, order confirmation, media license, or Client Service Agreement.
Some jurisdictions do not permit certain warranty exclusions or liability limitations. In those jurisdictions, the exclusions and limitations will apply only to the maximum extent permitted by law.
19. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Texas Skyline Media, Lone Star Realty Solutions, LLC, and their owners, members, managers, employees, contractors, representatives, affiliates, licensors, successors, and assigns from claims, damages, losses, liabilities, judgments, penalties, expenses, costs, and reasonable attorneys’ fees arising from or related to:
- Your use or misuse of the Site.
- Your violation of these Terms.
- Materials or information you submit.
- Your infringement of another person’s rights.
- Your lack of authority to request services for a property.
- Your fraudulent, unlawful, negligent, or intentional conduct.
- A claim that client-provided material infringes another person’s rights.
Texas Skyline Media may control the defense of any matter subject to indemnification, and you agree to reasonably cooperate with that defense.
20. SUSPENSION AND TERMINATION
Texas Skyline Media may restrict, suspend, or terminate your access to the Site or any Site feature if we reasonably believe that:
- You violated these Terms.
- Your activity creates a legal, security, safety, or reputational risk.
- Your conduct interferes with another user.
- Your activity interferes with the operation of the Site.
- Your account has been compromised.
- Suspension is necessary to comply with a legal obligation.
- The Site or applicable feature is being discontinued.
Termination does not eliminate rights or obligations that arose before termination.
Provisions concerning ownership, intellectual property, disclaimers, liability, indemnification, dispute resolution, and other provisions that logically should survive will remain effective after termination.
21. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and disputes relating to the Site will be governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Before filing a lawsuit, you and Texas Skyline Media agree to make a good-faith effort to resolve the dispute informally.
A party initiating a dispute must provide written notice describing:
- The nature of the dispute.
- The relevant facts.
- The requested resolution.
- Appropriate contact information.
The parties will have thirty days after receiving the written notice to attempt an informal resolution.
If the dispute is not resolved, either party may request non-binding mediation in Houston, Texas, before pursuing other available legal remedies.
Unless applicable law requires otherwise, legal proceedings concerning the Site must be brought before a state or federal court with proper jurisdiction in Texas.
Each party consents to the jurisdiction and venue of those courts.
Nothing in this section prevents either party from seeking immediate injunctive or equitable relief when necessary to prevent:
- Unauthorized use of intellectual property.
- Disclosure of confidential information.
- Security threats.
- Fraud.
- Other irreparable harm.
22. GEOGRAPHIC AVAILABILITY
Texas Skyline Media operates from Houston, Texas, and primarily provides services within Houston and surrounding areas.
The Site may be accessible outside our normal service area. Accessing the Site does not mean that services are available in every city, county, state, or country.
You are responsible for complying with laws applicable to your location and use of the Site.
23. SEVERABILITY
If a court determines that any provision of these Terms is invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permitted or modified to reflect its intended purpose.
The remaining provisions will remain in full force and effect.
24. NO WAIVER
Texas Skyline Media’s failure to enforce any provision of these Terms does not waive that provision or our right to enforce it later.
A waiver is valid only when made in writing by an authorized representative of Texas Skyline Media.
25. ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without prior written authorization from Texas Skyline Media.
Texas Skyline Media may assign these Terms in connection with:
- A merger.
- A reorganization.
- A sale of assets.
- A business transfer.
- A change of control.
- A transfer to an affiliated company.
26. ENTIRE AGREEMENT
These Terms and our Privacy Policy constitute the entire agreement concerning use of the Site and replace prior communications or understandings concerning that subject.
These Terms do not replace a separate proposal, invoice, order confirmation, media license, or Client Service Agreement governing professional services.
27. NO THIRD-PARTY BENEFICIARIES
These Terms are intended solely for the benefit of you and Texas Skyline Media.
They do not create rights or remedies for any other person or organization.
28. FEEDBACK
Suggestions, comments, ideas, and general feedback submitted through the Site or concerning our services will be considered non-confidential unless otherwise agreed in writing.
You grant Texas Skyline Media permission to use voluntary feedback for legitimate business purposes without compensation or attribution, provided that we do not publicly disclose your confidential information.
